This Policy applies as between you, the User or Platform User of this Website and Profiles4Care and the Client, the provider of this Website (and the Platform) and the facilitator of this Platform for Platform Users, respectively. This Policy also applies to Profiles4Care’s and/or the Client’s use of any and all Data and Sensitive Personal Data collected by Profiles4Care and/or the Client in relation to your use of the Website.

Scope of this Policy
This Policy is in relation only to the actions of Profiles4Care, the Client, Platform Users or Users with respect to this Website. It does not extend to any websites that can be accessed from this Website including, but not limited to, any links Profiles4Care may provide to social media websites.

Data Collected
Without limitation, any of the following Data may be collected by this Website from the Platform Users and/or Users: name; date of birth; gender; job title; profession; contact information such as email addresses and telephone numbers; demographic information such as post code, preferences and interests; IP address and web browser type and version.

Profiles4Care or the Client will also collect Sensitive Personal Data from Platform Users through the Platform as part of the surveys and questionnaires used by the Platform for the assessment of the Platform User.

Use of Data
Any personal Data or Sensitive Personal Data the User or the Platform User submit will be retained by Profiles4Care and/or the Client for a period of twelve (12) months or for the period necessary for the Client to carry out the assessment, analysis and/or evaluation of the Platform User, whichever ends later.

Unless Profiles4Care is obliged or permitted by law to do so, the User’s or Platform User’s Data and/or Sensitive Personal Data shall only be disclosed to the parties and persons stated in this Policy. This also includes affiliates and or other companies within Profiles 4 Care Limited group and the Client’s group.

All personal Data and Sensitive Personal Data stored by Profiles 4 Care Limited are secure in accordance with the principles of the Data Protection Act 1998 and GDPR.

Any or all of the Data may be required from the Users by Profiles4Care from time to time in order to provide the Users with the best possible service and experience when using the Website. Specifically, Data may be used by Profiles4Care for the following reasons; internal record keeping; to provide access to the Platform; improvement of products / services; transmission by email of promotional materials that may be of interest to the User or Platform User; or contact for market research purposes which may be done using email, telephone, fax or mail.

Any Sensitive Personal Data collected by Profiles4Care and/or the Client from the Platform User may be used by Profiles4Care and/or the Client for the following reasons: psychological evaluation including personality, intelligence and aptitude assessments; psychometric analysis; internal record keeping and improvement of products / services.

If Profiles 4 Care Limited or the Client sell or otherwise transfer part or the whole their assets to another organisation (e.g., in the course of a transaction in a merger, acquisition, bankruptcy, dissolution, liquidation), the User’s and the Platform User’s Data and/or Sensitive Personal Data and any other information collected through the Platform may be among the items sold or transferred. The buyer or transferee will have to honour the commitments provided in the Data Protection Act 1998. In the event that any Data or Sensitive Personal Data submitted by Users is to be transferred in such a manner, the User and/or Platform User will not be contacted in advance and informed of the changes.

Profiles4Care shall have the right to share with the respective Client any Data or Sensitive Personal Data provided in the Platform by the Platform User from which the Client has facilitated access.

Controller
Profiles 4 Care Limited, which you as a user entered an agreement with when using this web site, processes data as a Processor and as a Controller as defined in the Data Protection Act 1998 and the GDPR.

Profiles 4 Care Limited adheres to the Directive of 1995 and the GDPR from May 25th 2018. Consequently Profiles 4 Care Limited processes all data provided by its Users with accounts in its European Data Region, in the European Economic Area (EEA) only.

Third Party Services
Profiles4Care may, from time to time, employ the services of other parties for dealing with matters that may include, but are not limited to, software maintenance and upgrade, payment processing or advertising and marketing. The providers of such services will have access to certain personal Data and Sensitive Personal Data provided by Users and Platform Users.

Any Data used by such parties is used only to the extent required by them to perform the services that Profiles4Care requests. Any use for other purposes is strictly prohibited. Furthermore, any Data or Sensitive Personal Data that is processed by third parties shall be processed within the terms of this Policy and in accordance with the Data Protection Act 1998.

Other Websites
This Website may, from time to time, provide links to other websites. Profiles4Care has no control over such websites and is in no way responsible for the content thereof. This Policy does not extend to the use of such websites. Users are advised to read the privacy policy or statement of other websites prior to using them.

General
Wherever required to submit Data or Sensitive Personal Data, the User or Platform User shall have the option to restrict Profiles4Care’s and/or the Client’s use of such Data or Sensitive Personal Data. To exercise this right, the User or the Platform User shall contact Profiles 4 Care Limited at the email address provided above, or the Client in accordance with the contact details supplied by the Client directly to the User or Platform User.

If the User or Platform User believes that any information Profiles4Care or the Client are holding on them is incorrect or incomplete, they should contact Profiles 4 Care Limited or the Client as soon as possible. Profiles 4 Care Limited will promptly correct any information found to be incorrect.

The User or the Platform User have the right to ask for a copy of any of its personal Data or Sensitive Personal Data held by Profiles 4 Care Limited (where such data is held) free of charge. However, a small fee which will not exceed fifteen pounds Sterling (£15) may be charged when a request is excessive, particularly if it is repetitive for further copies of the same information.

Data security is of great importance to Profiles4Care and to protect the User’s and the Platform User’s Data and Sensitive Personal Data, Profiles4Care have put in place suitable physical, electronic and managerial procedures to safeguard and secure information collected via this Website.

Profiles 4 Care Limited reserves the right to change this Policy as it may deem necessary from time to time or as may be required by law. Any changes will be immediately posted on the Website and the User and Platform User are deemed to have accepted the terms of the Policy on your first use of the Website following the alterations.

Definitions and Interpretation
In this Policy the following terms shall have the following meanings:

Client”: means a Profiles 4 Care Limited customer which will facilitate the respective Platform User to access the Platform;
Data”: means collectively all data that the User or Platform User submit to Profiles4Care via the Website, excluding Sensitive Personal Data. This definition shall, where applicable, incorporate the definitions provided in the Data Protection Act 1998 and the GDPR;
Platform”: means the personality profiling platform operated by Profiles4Care, and which access is facilitated to the Platform User by the Client; platform
Platform User”: means any third party that accesses the Website to use the Platform to respond questionnaires and surveys prepared by Profiles4Care or the Client;
Profiles4Care”: means Profiles 4 Care Limited and the Platform Provider;
Profiles 4 Care Limited”: means Profiles 4 Care Limited of Manorhurst, Windmill Lane, Lewes Road, East Grinstead RH19 3SY
User”: means any third party that accesses the Website without using the Platform;
Sensitive Personal Data”: means data consisting of information as to: the racial or ethnic origin; age; religious beliefs or other beliefs of a similar nature; any proceedings for any offence, committed or alleged, including any sentencing decisions made by a court; physical or mental health or condition and/or information related to intelligence, aptitude, and/or personality traits.
